These Terms of Use (the "Terms") are a legal agreement between you and Simulator Arts LLC ("SimArts", "we", "us" or "our"), a company based in the United States, for the mobile game Combo 2: Stickman Fighting RPG on iOS and Android, including its updates and content (the "Game"). By downloading, installing or playing the Game, you agree to these Terms. If you don't agree, please don't use the Game.
These Terms add to, and do not replace, the terms of the app store you got the Game from (Apple App Store or Google Play). Our general Terms of Service also apply; if they conflict with these Terms on anything about the Game, these Terms apply.
1. Who can play
The Game is made for a general audience. If you are under the age of legal majority where you live, you may only use the Game with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases you make. Players under 13 should read these Terms together with a parent; the Game asks for a parent's confirmation before their purchases.
2. Your license
We give you a limited, personal, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment, on devices you own or control, as allowed by the app store's usage rules. The Game is licensed, not sold, to you. We and our licensors keep all rights not expressly granted to you.
3. Virtual currency and items
The Game includes virtual currencies (such as gems and gold) and virtual items (such as gear, upgrade materials, cosmetics, the Season Pass Premium, the Monthly Card and the Growth Fund) ("Virtual Items"). You can earn some by playing and buy some with real money.
- Virtual Items are licensed to you as part of your license to the Game. You do not own them.
- Virtual Items have no cash value. They cannot be exchanged for real money, goods or anything of value outside the Game, and they cannot be sold, traded or transferred.
- Some Virtual Items are delivered over time or last for a limited period, for example the Monthly Card (gems every day for 30 days), the Season Pass Premium (until the season ends) and the Growth Fund (gems as you reach certain levels). What each one includes is shown in the Game before you buy it.
- Upgrades in the forge succeed with the chance shown before you try. A failed upgrade uses the gold and materials shown but never lowers an item's level.
- We may change, rebalance, rename or remove Virtual Items and their prices or effects, for example to keep the Game fair and fun. Where the law requires, we will not reduce what you already paid for without notice.
- Virtual Items are non-refundable, except as required by applicable law or the refund policy of the app store you bought them from.
- Because your progress is stored on your device (see Section 7), unspent currency and other Virtual Items can be lost if you delete the Game, clear its data, or lose or replace your device. One-time purchases, such as the Starter Pack, the Growth Fund and No Ads, can be restored; consumable items and in-game currency cannot.
4. Purchases and refunds
- All in-app purchases are processed by Apple or Google, not by us. Their terms govern payment, billing and refunds, and the price you pay is the price shown by the store at checkout.
- The Game has no subscriptions: nothing renews or charges you automatically.
- We don't receive your payment details and can't issue refunds ourselves. To request a refund, use Apple's "Report a Problem" process for App Store purchases, or Google Play's refund process for Google Play purchases.
- If a purchase doesn't arrive, first try Restore purchases in the Game's Store, then contact support.
- If the store refunds or reverses a purchase, we may remove the related Virtual Items from your Game.
- If you live in the EU or UK: by buying digital content that is delivered immediately, you agree to its immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery begins, as allowed by law.
5. Advertising
The Game shows only optional rewarded ads, which you choose to watch in exchange for an in-game reward, up to 5 a day. There are no banner ads and no ads between levels. Rewards are granted only when a rewarded ad is completed, and ads may not always be available. We are not responsible for the content of third-party ads or for products and services they promote, and your dealings with advertisers are between you and them. The optional "No Ads" purchase gives you rewarded-ad rewards instantly, without watching an ad; the daily limit still applies. How ad partners use data is explained in our Privacy Policy.
6. Fair play and acceptable use
You agree not to:
- cheat, or use bots, scripts, macros or other automation to play the Game;
- change your device's date, time or time zone (clock manipulation) to speed up timers, rewards or other time-based features;
- mod, hack, patch or otherwise change the Game, its save files or its memory, or use a modified version of the Game;
- exploit bugs or glitches for an advantage (please report them to us instead);
- get around ads, purchases or other features, or obtain Virtual Items through unauthorized means;
- reverse engineer, decompile or disassemble the Game, except where the law expressly allows it;
- copy, rent, sell, sublicense or distribute the Game or any part of it;
- give your hero an offensive, hateful or misleading name, or use your real full name or other personal information as your hero's name (the Game may refuse such names);
- use the Game in any way that breaks the law or these Terms.
The Game checks for tampering on your device, for example by signing your save file. If we reasonably believe you have broken these rules, we may reset or remove affected progress or Virtual Items, or end your license, without refund except where the law requires one.
7. Your progress and data
The Game has no accounts. Your progress, settings and purchase records are saved on your device. We cannot recover or transfer progress that is lost, for example after deleting the Game, clearing its data, using Settings > Privacy > Delete data or changing devices. Device backups may help, depending on your device settings.
8. Health and safety
A very small number of people may have seizures or blackouts when exposed to certain light patterns or flashing lights, including in video games, even with no history of epilepsy. If you or anyone in your family has had such a condition, consult a doctor before playing. Stop playing at once and seek medical advice if you notice dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation or any involuntary movement. The Game offers Reduce flashes, Screen shake and Vibration settings. Take regular breaks and stay aware of your surroundings while you play.
9. Updates and changes to the Game
We may release updates that fix bugs, change gameplay or balance, or add or remove content. Some updates may be required to keep playing. We may also stop offering or supporting the Game at any time. Where the law requires, we will give reasonable notice of changes that significantly affect content you paid for.
10. Ownership
The Game and everything in it, including code, art, characters, animations, music, text and the "Combo 2" name and logo, are owned by SimArts or its licensors and protected by intellectual property laws. Some components may be provided by third parties under their own licenses; the Game's credits list them. If you send us feedback or suggestions, we may use them without any obligation to you.
11. Privacy
Our Privacy Policy for Combo 2: Stickman Fighting RPG explains how information is handled when you use the Game.
12. Termination
You can end these Terms at any time by deleting the Game. We may end or suspend your license if you break these Terms or if we stop offering the Game. When these Terms end, you must stop using the Game, and your rights to Virtual Items end. Sections 3, 10 and 13 to 17 continue to apply.
13. Disclaimer of warranties
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Game will be uninterrupted, error-free, or compatible with every device.
Some places do not allow these exclusions, so some of them may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
14. Limitation of liability
To the fullest extent permitted by law, SimArts will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress, Virtual Items, profits or goodwill, arising from or related to the Game. Our total liability for any claim related to the Game will not exceed the amount you paid for in-app purchases in the Game in the 12 months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Governing law and disputes
These Terms are governed by the laws of the United States, without regard to conflict of law principles, consistent with our general Terms of Service. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally.
Where permitted by law, any dispute arising out of or relating to these Terms or the Game will be resolved by binding individual arbitration in the United States, and you and we each waive the right to participate in a class action or class-wide arbitration, as described in Sections 20 and 21 of our general Terms of Service. Either party may bring an individual claim in small claims court instead.
If you are a consumer in the European Union, the United Kingdom or another country whose laws give you mandatory protections, you keep those protections, including the right to bring a claim in the courts where you live.
16. Additional terms for Apple devices
If you downloaded the Game from the Apple App Store:
- These Terms are between you and SimArts only, not Apple. We, not Apple, are responsible for the Game and its content.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the Game. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the Game.
- We, not Apple, are responsible for handling any claims relating to the Game or your use of it, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- We, not Apple, are responsible for the investigation, defense, settlement and discharge of any claim that the Game infringes a third party's intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (such as your wireless data agreement) when using the Game.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them to a successor of the Game. These Terms, together with the documents they refer to, are the entire agreement between you and us about the Game.
18. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the effective date. If a change is significant, the Game will ask you to review and accept the updated Terms before you keep playing.
